Theme:Intellectual Property and Competition Law in the Age of Multi-Agential Governance

 Modern societies are governed by multilayer networks of rules and norms, which are not only set up by legislatures, courts or administrative agencies anymore. Many everyday activities become more often regulated by industry standards set up by various private consortia or by terms and conditions of standard contracts used by many private entities. Within this network of multi-agential governance, the borders of intellectual property law are challenged every day by diverse stakeholders especially with regard to use of intellectual property rights to restrict other competitors from entering into market or from conducting certain business activities on the market. The questions thus arise (a) what relationship between intellectual property law and competition law should be and (b) whether it is possible to create an interface between intellectual property law and competition law to induce further creativity and innovation, while preserving competition on the market.
 

The Hokkaido University Research Institute for Information Law & Policy launches the Intellectual Property Junior Researchers’ Essay Contest 2011 on the theme Intellectual Property and Competition Law in the Age of Multi-Agential Governance. The Institute invites junior IP or competition law scholars resident in Japan (i.e. doctoral students and young researchers up to 5 years after obtaining their doctoral degree without the tenure-track position) to submit an essay on any intellectual property law or competition law related topic, which addresses any aspect of above-described theme. The essay should not be longer than 6,000 words (including footnotes) in English or 18,000 characters (including footnotes) in Japanese. It should be submitted in PDF file or Microsoft Word file by e-mail (coeip@juris.hokudai.ac.jp) not later than July 10, 2011.

The price for up to two authors of most interesting and thought provoking essays will be the invitation to present their essays on an international conference organized by the Hokkaido University School of Law in Sapporo on August 18-20, 2011. As the Conference will be held in English with Japanese consecutive translation, the invited speakers will be encouraged to present their work in English. However, the presentation in Japanese is also acceptable. In such case, the consecutive translation will be provided. This will provide the invited junior researchers with a great opportunity to present their works before senior leading scholars in different areas of intellectual property law and competition law in Japan, as well as abroad, and to obtain valuable feedback on their works from them. The Hokkaido University School of Law will cover the travel expenses within Japan (economy class airfare) and the reasonable accommodation expenses in Sapporo for up to two invited junior researchers during the Conference. Please note that the School of Law reserves the right not to award any price in this contest. The selected researchers will be notified on their invitation by July 15, 2011.
